The Government has officially launched a new version of OSS under the name Online Single Submission Risk-Based Approach (OSS-RBA) with Government Regulation Number 5 of 2021. Pursuant to Government Regulation No 5 of 2021 regarding the Operation of Risk-Based Business Licenses or Peraturan Pemerintah Nomor 5 Tahun 2021 Tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko (“GR No. 5/2021”), OSS is a business license issued by the Ministry of Investment/BKPM for and on behalf of the Minister, Leader Institution, Governor, or Regent/Mayor, to the business actors through integrated electronic systems. The NIB (Business registration number) itself, is valid as long as the company continues to conduct its business activities. After obtaining the NIB, the company shall apply for the Business License in accordance with its business activities and after obtaining the Business License, the company shall be obliged to fulfill a commitment in the OSS application. With the OSS online platform, entrepreneurs who want to apply for a business licenses can go through online facilities and no longer need to visit the licensing service office.
Following GR No. 5/2021, the Ministry of Investment/BKPM BKPM has issued three Implementing Regulations of GR No. 5 of 2021 as follows:
- BKPM Regulation No. 3 of 2021 concerning the Electronically Integrated Risk-Based Business Licensing System
- BKPM Regulation No. 4 of 2021 concerning Guidelines and Procedures for Risk-Based Business Licensing Services and Investment Facilities
- BKPM Regulation No. 5 of 2021 concerning Guidelines and Procedures for Supervision of Risk-Based Business Licensing
